Question for experienced wholesalers...
An end buyer/principal; who has showed valid POF to the wholesaler (these two individuals have never done business before), is willing to pay an assignment fee for a contract, however the end buyer wants his attorney instead of the wholesaler's attorney to hold the deposit and assignment fee to be paid out only and after a successful closing.
It sounds to me that the end buyer's attorney is holding all the control, and if he wishes he can always hold on to the assignment fee (even though there is signed agreement) and not pay it. In your opinion is it safe for the wholesaler to structure the deal this way so she can successfully get paid her assignment fee? Thanks in advance.
