Here is the situation. Two friends are sharing an apartment in a house. They don't get along.
The Landlord wants one of them out, his least favorite tenant however he does not want to move.
They have been living there for 2 years without a lease. The only proof of occupancy are the cancelled checks for rent.
Can the Landlord just evict his tenant? what recourse does the landlord have? The tenat?
Do you know the answer? Can anyone recommend a Real Estate attorney in NJ?

If they do not have a written lease they are automatically under a month to month lease. There are several reasons for eviction - bad behavior, late rent,. Maybe he can raise the rent i they can't afford it they will have to move. Are they taking care of the property? He can't just evict if he doesn't like him but if not a good tenant he can.
